Only one in three patients in the ICU is currently under the care of an intensivist. Shouldn’t more patients in the ICU receive optimal medical care from physicians who are specifically trained in critical care medicine and provide the majority of their care in an ICU setting? Should Medicare reverse, or at least delay until physician concerns can be adequately addressed, its decision to eliminate payment for consultation service codes?

On November 21, the US Senate voted to begin debate on health system reform and formally consider HR 3590, the Patient Protection and Affordable Care Act, by a party-line vote of 60-39.

The American College of Chest Physicians (ACCP) closely reviewed the Medicare Physician Fee Schedule (MPFS) proposed rule and submitted written comments to the Centers for Medicare and Medicaid Services (CMS) requesting that they remove the proposal to eliminate consultation codes or at least delay the implementation of the proposal.

On October 21, 2009, the US Senate was unable to obtain the 60 votes necessary to invoke cloture to vote on S 1776, the Medicare Physicians Fairness Act of 2009. The motion failed on a vote of 47-53.
